Terms of sale

1. Purpose

These terms of sale (the “Terms”) govern the sale of render credits on the website poolvisionia.com, published by Novalgos (see the legal notice). Placing an order implies full acceptance of these Terms.

2. Service

Pool Vision AI is an online service that uses artificial intelligence to generate, from a photograph of the user's backyard, photorealistic renders of a pool integrated into that setting.

Renders are visual simulations intended to support a decision. They are not a technical construction document.

3. Free trial

The user receives 2 free renders, delivered with a watermark, to try the service with no commitment. These free renders cannot be combined, are not refundable, and may be changed or withdrawn at any time.

4. Credits and prices

HD renders without a watermark are available by purchasing credits. 1 credit = 1 HD render (pool cover and deck options included). Object cleanup (eraser) adds 1 credit to the render. The cinematic video costs 1 credit. Current prices are:

Prices are shown in US dollars; the price shown is the amount charged. This is a one-time payment, with no subscription and no commitment. Purchased credits do not expire and can be used across several projects. Novalgos reserves the right to change its prices at any time; the applicable price is the one in effect on the day of the order.

5. Order and payment

Payment is made online by card through our secure payment provider. Novalgos never has access to the user's full card details. The order is confirmed as soon as payment is confirmed, and the credits are added to the user's account immediately. An invoice is available on request at contact@novalgos.com.

6. Right of withdrawal

In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content supplied on an intangible medium once performance has begun, with the consumer's express consent, before the end of the withdrawal period.

By purchasing credits and generating a render, the consumer expressly acknowledges that performance of the service begins immediately and therefore waives the 14-day right of withdrawal for credits already used. Credits not yet used may be refunded within the statutory 14-day period, on request at contact@novalgos.com.

7. User obligations

The user undertakes to upload only photographs to which they hold the rights, and not to use the service for unlawful purposes. The user is solely responsible for the content of the images they upload.

8. Liability and warranties

The service is provided “as is”. The quality and realism of the renders depend, among other things, on the quality of the photograph provided. Novalgos makes every effort to keep the service available but does not guarantee uninterrupted operation. Novalgos's liability shall not exceed the amounts actually paid by the user.

9. Personal data

The processing of personal data is described in our privacy policy.

10. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, a consumer may use a consumer mediator free of charge (contact details available on request at contact@novalgos.com). Failing an amicable resolution, the French courts shall have jurisdiction. Consumers may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
